دسترسی به برق به ‏عنوان حق جهانی بشر با مطالعه رویکرد نوین اتحادیه اروپا

چکیده
دسترسی به برق در دنیای معاصر به حدی حایز اهمیت است که از معمول‏ترین فعالیت‌های روزمره مانند استفاده از تلفن همراه تا ضروری‌ترین امور پزشکی، به آن وابسته است. با این حال، در اسناد بین‌المللی، دسترسی به برق تنها در موارد محدودی و به‌طور ضمنی یا صریح مورد توجه قرار گرفته است که این موضوع موجب تردید در خصوص شناخت آن به‌عنوان یک حق بشری می‌شود. به همین دلیل، پژوهش حاضر به بررسی نظریه‌های مختلف در خصوص ماهیت‌شناسی حق دسترسی به برق پرداخته است و سعی دارد پاسخ دهد که آیا دسترسی به برق به‌عنوان یک حق بشری شناخته می‌شود یا خیر. هم‏چنین، در این تحقیق بررسی می‌شود که آیا هر قطع برقی نقض حق بشری محسوب می‌شود یا خیر، و در صورت نقض این حق، کدام حقوق دیگر ممکن است تحت تاثیر قرار گیرند. در ادامه، در این پژوهش، نظام حقوقی اتحادیه اروپا به‌عنوان یکی از قانون‌گذاران فعال در زمینه دسترسی به برق، تحلیل می‌شود. این پژوهش هم‏چنین به تفاسیر حقوقی که بخش مهمی از حقوق بشر را شکل می‌دهند، توجه دارد و در آن، مهم‌ترین این تفاسیر مرتبط با دسترسی به برق مورد بررسی قرار گرفته‏اند. نتایج تحقیق نشان می‌دهد که شناسایی دسترسی به برق به‌عنوان یک حق بشری، نه‌تنها موجب افزایش توجه به این مساله در سطح بین‌المللی می‌شود، بلکه دولت‌ها را ملزم می‌سازد تا اقدامات عملی را برای تامین دسترسی همگانی به این حق، انجام دهند. در نهایت، این تحقیق به اهمیت شناسایی دسترسی به برق به‌عنوان یک حق بنیادین در راستای ارتقای توسعه پایدار و حفظ حقوق بشر در سطح جهانی می‌پردازد.
