A comparative study of the principle of cooperation regarding the ‎exploitation of shared waters in the treaty and judicial systems of ‎Europe, Africa, Asia and America

Abstract
The importance of water resources has doubled the need for multilateral actions by international actors, especially countries. Some regions have faced the challenge of lack of water resources, and others have faced the challenge of a large volume of these waters being unused. Therefore, the issue of achieving a fair and rational solution in the field of common water allocation is taken into consideration; because the said challenge can have adverse effects on current and future generations. For this reason, bilateral or multilateral legal documents and agreements along with executive and judicial procedures located in important regions of the world including Europe, Asia, America and Africa have been examined, and the ways of dividing water resources in order to apply good governance over these resources have been examined and the existing legal gap in the legislative approach. The executive and judicial authorities governing these areas with special attention to the principle of reasonable and fair use, prohibition of harm to others and cooperation between countries in order to provide the highest amount of services to the entire human society have been deduced that all these cases are aimed at reasonable and fair allocation of common water resources. Among the countries located in a watershed, it has been according to the needs of current and future generations. The comprehensive framework of treaties between countries for concluding future agreements is considered as an innovation that can be applied in different parts of the world.
