Cogeneration of heat and power is one of the common methods using in electricity production. Researches has shown that the main approaches of the EU in the energy sector, including energy efficiency, security of supply and Prevention of emissions, are better achieved in the method of Cogeneration. In the current legal system of the EU, the measures required regarding Cogeneration are affected by the Clean Energy Package regulations and a consolidation of the 2012 regulations and the amendments made in 2018 to 2019. Economic effectiveness, energy efficiency, favorable environmental effects, short construction period with transferability, having an energy supply source with a high protection factor(passive Defense), increasing reliability, reducing the effect of network fluctuations, improving power quality, preventing the increase of network capacity, reducing fuel consumption, providing reactive power, reducing energy transmission density, peak efficiency, and reducing margins are among the most important advantages and functions of this special legal regime. In Iran's legal system, although the law on reforming the consumption pattern has recognized the use of this method in power generation; But this law only oversees the construction of new power plants and is silent about existing power plants. In this article, with a descriptive-analytical approach, the legal policy of the two mentioned systems is examined, and finally, while identifying the existing legal problems and obstacles, the necessary suggestions for amending the laws and regulations are presented.
