Therefore, it is very necessary to examine the existing capacities for applying preventive measures in the executive stages and before the case reaches the judicial stages, because this can help, with the knowledge it creates, to make more use of the actual capacities and to actualize the latent capacities or to create new capacities. This article addresses this issue with a descriptive-analytical method and library tools, and the results of the study indicate the existence of desirable capacities in this field that require more attention and use. <span dir="RTL" lang="FA">پیرو نظریات ارایه شده پیرامون کیفر به‏مثابه آخرین چاره، و اهمیت و اولویت تدابیر پیشگیرانه غیرکیفری بر تدابیر کیفری باید گفت که پیشگیری از ارتکاب جرایم علیه کمیت و کیفیت منابع آبی کشور با توجه به بحران آب موجود، هم منافع جمعی (از لحاظ حفاظت بیشتر از منابع مذکور) و هم منافع و حقوق بزهکاران این جرایم را بهتر تامین می کند. از این رو، بررسی ظرفیت‏های موجود برای به‏کار بردن تدابیر پیشگیرانه در مراحل اجرایی و قبل از رسیدن پرونده به مراحل قضایی بسیار ضروری است؛ چراکه این امر می تواند با آگاهی‏ای که ایجاد می کند برای بهره‏گیری بیشتر از ظرفیت‏های بالفعل و برای به‏فعلیت رساندن ظرفیت‏های بالقوه و یا ایجاد ظرفیت‏های جدید کمک‏کننده باشد. این مقاله با روش توصیفی- تحلیلی و ابزار کتابخانه‏ای به این مهم پرداخته و نتایج مطالعه صورت گرفته، حاکی از وجود ظرفیت‏های مطلوبی در این زمینه است که نیازمند توجه و بهره‏گیری بیشتر هستند.</span> https://ewl.nri.ac.ir/article_252743_b8fb4ac1b21fadffb20631934c2c2640.pdf
