In such a way that each of the important regions of the world, including Europe, America, Asia, and Africa, have concluded important legal documents and, accordingly, they have prepared specific rules in this regard. Europe due to having a systematic and integrated approach, Africa due to the establishment of multiple water institutions with a consensus decision-making method, Asia due to giving importance to the ecological needs of nature when allocating water resources, and America due to the attention and putting the framework agreement on the agenda. Each of them involved innovations in the management of common water resources; But despite that, important regional documents have not included different legal requirements from each other; Rather, the requirements explained by these documents were common and therefore, the said documents did not have a regional function and each one did not establish unique and separate legal requirements; Rather, all of them have been based on the two important principles of the no-harm and equitable and reasonable utilization. <span dir="RTL" lang="FA">شیوه بهره‌برداری از آب‌های مشترک به‏دلیل کمبود این منابع و تعدد کشورهای ذی‏نفع از دیرباز از اهمیت فراوانی برخوردار بوده است؛ به‏گونه‌ای که هر یک از مناطق مهم جهان شامل اروپا، آمریکا، آسیا، و آفریقا، اسناد حقوقی مهمی را به انعقاد رسانده‌اند و به‏تناسب، ضوابط مشخصی را نیز در این خصوص تدبیر نموده‌اند. در این مقاله اسناد مناطق مختلف به روش کتابخانه‌ای و تحلیلی مورد بررسی قرارگرفته‌اند. در این میان، اروپا به‏دلیل دارا بودن رویکرد نظام‌مند و یکپارچه، آفریقا به‏دلیل تاسیس نهادهای آبی متعدد با شیوه تصمیم‌گیری به روش اتفاق‌آرا، آسیا به‏دلیل اهمیت دادن به نیازهای بوم‏سازگانی (اکولوژیکی) طبیعت هنگام تخصیص منابع آب، و قاره آمریکا به‏دلیل در دستور کار قرار دادن قرارداد چهارچوب، هر یک متضمن نوآوری‌هایی در زمینه نحوه مدیریت منابع آبی مشترک بوده‌اند. با این حال، اسناد مهم منطقه‌ای متضمن الزامات حقوقی متفاوتی از یکدیگر نبوده‌اند؛ بلکه الزاماتی را که این اسناد تبیین نموده‌اند، به‏صورت مشترک بوده و درنتیجه، اسناد مذکور از کارکرد منطقه‌ای برخوردار نبوده‌اند و هر یک الزامات حقوقی منحصربه‌فرد و جداگانه‌ای را مقرر ننموده‌اند. در واقع، تمامی اسناد مزبور حول دو اصل مهم «منع ورود زیان» و «استفاده معقول و منصفانه» قرار داشته‌اند.</span> https://ewl.nri.ac.ir/article_235674_d55342c42bb2f757f82c89005b4bafd5.pdf
